Terms of Service

§1. General Provisions

These Terms of Service govern the provision of electronic services by the Service Provider indicated in the contact section, in accordance with applicable laws on electronic service provision.

These Terms specify in particular: the types and scope of services provided electronically, conditions for providing these services, conditions for concluding and terminating contracts for electronic services, and the complaint procedure.

§2. Definitions

Terms used in these Terms of Service mean:

  • Service Provider – the entity providing electronic services, as indicated in the contact section
  • User – a natural person, legal person, or organizational unit without legal personality using services provided by the Service Provider
  • Consumer – a User who is a natural person performing a legal act not directly related to their business or professional activity
  • Service – an electronic service provided by the Service Provider to the User via the Website
  • Website – the website operated by the Service Provider at the address indicated in the configuration
  • Account – the User's individual account on the Website, protected by a password
  • Agreement – a contract for the provision of electronic services concluded between the Service Provider and the User

§3. Types and Scope of Services

The Service Provider provides the following electronic services:

  • Providing tools based on artificial intelligence
  • Generating and processing content using AI algorithms
  • Maintaining User accounts
  • Sending commercial information (newsletter) – with User consent

Services are provided in a test (beta) version. Functionality may be limited and subject to change.

§4. Technical Requirements

Using the Website requires meeting the following technical requirements:

  • A current web browser with JavaScript and cookies enabled
  • An active Internet connection
  • An active email address (for registration and communication)
  • An end device (computer, tablet, smartphone) with Internet access

§5. Prohibition of Unlawful Content

The User agrees to:

  • Use the Website in accordance with applicable law and good practices
  • Not provide content of an unlawful nature, including content infringing third-party rights
  • Not take actions that may disrupt the proper functioning of the Website
  • Not abuse AI services in a manner that could violate the rights of others or legal regulations

The User bears full responsibility for content generated using the Website's services.

§6. Contract Conclusion and Termination

The contract for the provision of electronic services is concluded:

  • Upon registration of an account on the Website – for services requiring registration
  • Upon starting to use the Website – for services not requiring registration

The User may terminate the contract at any time by:

  • Deleting the account on the Website
  • Unsubscribing from the newsletter (link in each message)

The Service Provider may terminate the contract with immediate effect in case of breach of these Terms by the User.

§7. Right of Withdrawal (Consumers)

A Consumer has the right to withdraw from a distance contract without giving any reason within 14 days from the date of conclusion of the contract.

The withdrawal statement can be made in any form, including electronically to the email address indicated in the contact section.

The right of withdrawal does not apply to services started with the express consent of the Consumer before the expiry of the withdrawal period, of which the Consumer was informed.

Sample withdrawal statement: "I hereby inform you of my withdrawal from the contract for the provision of services [service name], concluded on [date]. Consumer's name: [data]. Email address: [email]. Date: [date]. Signature (if the form is sent in paper form)."

§8. Complaint Procedure

The User has the right to submit complaints regarding the services provided.

Complaints can be submitted electronically to the email address indicated in the contact section.

A complaint should include: User data, description of the problem, and the expected method of complaint resolution.

The Service Provider will consider the complaint within 14 days of receiving it and inform the User of the resolution.

Consumers have the option to use out-of-court complaint and redress mechanisms, including the ODR platform at: https://ec.europa.eu/consumers/odr/

§9. Liability

The Service Provider is not liable for:

  • Actions of third parties, including other Users
  • Service interruptions resulting from causes beyond the Service Provider's control (force majeure)
  • Content generated by Users using AI tools
  • Decisions made by Users based on AI-generated content

The service is provided in beta version "as is", without warranty of completeness, reliability, or fitness for a particular purpose.

The Service Provider's liability to Users who are not Consumers is limited to the amount of fees paid by the User in the last 12 months.

§10. Intellectual Property

The Website and its content (including software, texts, graphics, logos) are the property of the Service Provider or third parties and are protected by copyright.

The User retains rights to content they create and input into the Website.

The User grants the Service Provider a non-exclusive license to use content input into the Website to the extent necessary to provide services.

Content generated by AI within the service may be used by the User in accordance with applicable law.

§11. Changes to Terms

The Service Provider reserves the right to change the Terms for important reasons, such as:

Changes in legal regulations, changes in the scope or manner of providing services, security considerations.

Users will be notified of changes to the Terms with 14 days' notice via a message on the Website or email.

Continued use of the Website after the changes take effect constitutes acceptance thereof.

§12. Final Provisions

Matters not regulated in these Terms are governed by applicable law, in particular:

  • Civil Code
  • Act on Providing Services by Electronic Means
  • Consumer Rights Act (in relation to Consumers)
  • Data Protection Act and GDPR

The court competent to resolve disputes is the court having jurisdiction over the Service Provider's registered office, subject to Consumers' rights to bring action before a court having jurisdiction over their place of residence.
